THE PAKISTAN CRIMINAL LAW (WEST PAKISTAN AMENDMENT) ORDINANCE, 1970

An Ordinance to amend the Pakistan Criminal Law Amendment Act, 1958, in its application to persons (not being members of an All-Pakistan Service) who are serving in connection with the affairs of the Province of West Pakistan

Preamble

WHEREAS it is expedient to amend the Pakistan Criminal Law Amendment Act, 1958, in its application to persons (not being members of an All-Pakistan Service) who are serving in connection with the affairs of the Province of West Pakistan, in the manner hereinafter appearing;

NOW, THEREFORE, in pursuance of the Martial Law Proclamation of 25th March, 1969, read with the Provisional Constitution Order, and in pursuance of all powers enabling him in that behalf, the Governor of West Pakistan is pleased to make and promulgate the following Ordinance:-

1. Short title and commencement

(1) This Ordinance may be called The Pakistan Criminal Law (West Pakistan Amendment) Ordinance, 1970.

(2) It shall come into force at once.

2. Amendment of section 12 of Act XL of 1958

In the Pakistan Criminal Law Amendment Act, 1958, in its application to persons (not being members of an All-Pakistan Service) who are serving in connection with the affairs of the Province of West Pakistan, in clause (a) of sub-section (2) of section 12, between the word “prosecution” and the word “on” , the words “and to withdraw prosecution” shall be inserted.

This Ordinance was promulgated by the Governor of West Pakistan on 30th January, 1970; published in the West Pakistan Gazette (Extraordinary), dated 6th February, 1970, pages 269-270; saved by Article 281 of the Interim Constitution of Pakistan (1972); and, validated by the Validation of Laws Act, 1975 (LXIII of 1975).
