<p style="text-align: justify;"><strong>1. You have a right to work in any EU member state, but will be taxed like a local.</strong></p>
<p style="text-align: justify;">Since the conception of the EU, one of the major changes for every country involved has been the freedom of movement of workers. You do not have to apply for any sort of visa or work permit to work in another EU member state, but don’t expect to be treated any different from the local workers there. Income tax rates vary from one country to another, being as low as 5% in some places, like Bosnia and Herzegovina, or as high as 56.6% in Sweden.</p>
<p style="text-align: justify;"><strong>2. You may have to pay social security / national insurance out of your income, or healthcare may not be free. </strong></p>
<p style="text-align: justify;">Not every country in the EU has free national healthcare. Many countries will take a tax out of your wages towards healthcare, but don’t presume that means you will be treated for free. The 27 member states of the EU plus Iceland, Liechtenstein and Norway are all covered by the European Health Insurance Card, which you will need to obtain before you travel. This will entitle you to free healthcare where the country has a national health service, or reduced cost healthcare in other countries.</p>
<p style="text-align: justify;"><strong>3. EU member states have very varying rates of corporate tax.</strong></p>
<p style="text-align: justify;">At the moment Belgium charges 34%, whereas Ireland charges 12.5%. If you are considering starting a business abroad or expanding your business into another country, you should check your liabilities and work these into your feasibility studies before making any costly decisions.</p>
<p style="text-align: justify;"><strong>4. Member states also have variable VAT rates.</strong></p>
<p style="text-align: justify;">VAT paid on goods and services can be very different from one country to another, but there are some restrictions since the EU placed caps on the maximum and minimum member states are allowed to charge. Still, the rate can vary from as high as 27% in Hungary to as low as 15% in Luxembourg, so take this into consideration when weighing up your finances.</p>
<p style="text-align: justify;"><strong>5. Europe still harbours some tax havens.</strong></p>
<p style="text-align: justify;">Yes, the elusive tax haven does exist, and many are well used by frugal billionaires around the continent. A good example is Andorra, where workers are not charged any income tax, there is no Capital Gains Tax, death duties or sales tax. Added to this there is a low import tax of around 2 – 5%, making it a popular place for online businesses and high rolling investors. Interestingly, Andorra also has the highest life expectancy of anywhere in Europe – an impressive 83 years!</p>
<p style="text-align: justify;"><strong>6. Importing and exporting may not be as cheap as you think.</strong></p>
<p style="text-align: justify;">Goods that are exported to non member countries are not charged any VAT at the point of sale, but there may be VAT to pay upon arrival in the home country. Goods imported to the EU must have the applicable VAT paid as soon as the goods are imported so as to put them on an even keel with the local goods.</p>
<p style="text-align: justify;"><strong>7. Road tax is a complicated issue.</strong></p>
<p style="text-align: justify;">If you are going to be using local cars, operating vans or haulage vehiclesor moving your own car to the continent, you will need to do your homework as to the applicable road tax where you are going. Also referred to as a vignette, the amount payable and point at which it should be paid varies wildly across the EU, and if you fail to meet the legal obligations you could be facing a fine of many hundreds of Euros. <p style="text-align: justify;">The Uniform Crime Reporting (UCR) Program for the Department of Justice and FBI compiles statistics for the number of arrests in the United States based on 28 separate offenses. The most recent statistics available are for 2010. These particular statistics are based only on arrests and do not take into consideration whether there was a prosecution or any other disposition of the case.</p>
<p style="text-align: justify;">The numbers do not reflect the number of people arrested, but the number of offenses charged. For example, if a person is arrested for a drug abuse violation and also charged with driving under the influence, this will show up as two separate offenses. One person is arrested, but two crimes are reported.</p>
<p style="text-align: justify;">The statistics do not consider any arrests of any person under the age of 18 even if the arrest was made in a state that would consider the person an adult. The five most common reasons for the arrest of adults are listed below.</p>
<p style="text-align: justify;"><strong>1) Drug Abuse Violations</strong></p>
<p style="text-align: justify;">By far, the most arrests in the United States in 2010 were for drug abuse violations. This includes arrests for manufacturing, selling, and possessing all known illegal drugs. There were 1,643,962 arrests in this category. Possession of marijuana was the primary reason for drug abuse arrests. Arrests for heroin and cocaine abuse trailed significantly behind those for marijuana. There were more arrests for simple possession of drugs than there were for manufacturing or selling them.</p>
<p style="text-align: justify;"><strong>2) Driving Under the Influence</strong></p>
<p style="text-align: justify;">Driving under the influence of alcohol came in second as a reason for arrest. In 2010, there were 1,412,223 arrests in the U.S. for this particular offense. The Center for Disease Control and Prevention estimates that 30 people die daily as a result of an alcohol impaired driver. Other estimates are that one in 140 drivers have been arrested for drunk driving. In 2010, more men than women were arrested for this offense.</p>
<p style="text-align: justify;"><strong>3) Larceny-Theft</strong></p>
<p style="text-align: justify;">Larceny-theft is a property crime. Property crimes include burglary, arson, and motor theft as well as larceny-theft, which accounts for 68.1 per cent of all property crimes. Larceny-theft occurs when someone takes away the property “from the possession or constructive possession of another” without using force or violence or fraud. Examples of this crime include shoplifting and purse snatching. Embezzlement and fraud are not in this category.</p>
<p style="text-align: justify;"><strong>4) Assaults </strong></p>
<p style="text-align: justify;">All assaults not considered to be aggravated assaults come in fourth on the list of top five reasons people are arrested. &#8220;Simple assault&#8221; occurs when one person unlawfully attacks another but no weapon is involved and no apparent injury is inflicted. Threatening someone with words or any conduct that puts a person in fear of bodily harm without brandishing a weapon is considered intimidation and an assault. Stalking a person also falls under the category of assault.</p>
<p style="text-align: justify;"><strong>5) Aggravated Assault</strong></p>
<p style="text-align: justify;">The fifth most common reason for arrest is aggravated assault. Aggravated assault falls into the category of violent crime and is defined as an unlawful attack by a person &#8220;for the purpose of inflicting severe or aggravated&#8230;bodily injury&#8230;usually accompanied by the use of a weapon&#8230;.&#8221; A weapon does not have to be a gun or knife or any other item generally associated with the word weapon. As long as the item used is capable of causing bodily injury, under this definition, it is considered a weapon. Even a person’s fists have been considered a weapon for purposes of aggravated assault.</p>
<p style="text-align: justify;">If a person knows they have a deadly disease and intentionally tries to give another person that disease by biting, spitting, or causing any exchange of bodily fluid, the person can be arrested for aggravated assault.</p>

<p style="text-align: justify;" dir="ltr">There are derogations that enable the parties to adjust their obligations. Some of the instances where human rights law is derogated are during conflicts of arms, civil problems, environmental disasters, natural disasters and violent unrest.</p>
<p style="text-align: justify;" dir="ltr">Let&#8217;s talk about human rights law. Basically, it pertains to a set of laws that permit individuals to express their right to freedom expression and economy. It also encompasses cultural and economic rights. But there are a myriad of instances when these rights are bypassed, even totally ignored.</p>
<p style="text-align: justify;" dir="ltr">Not all people are also aware of their different human rights. The right to equality is often trampled. In this day and age, many people still discriminate race and color, particularly amongst schools and the workforce. The discriminated parties often develop tolerance to these slights to their rights to equality. But often times, there are repercussions to the people involved.</p>
<p style="text-align: justify;" dir="ltr">Gender inequality is also a part of the this law. Women have been voting since 1913 but gender inequality is still very prominent in many nations even outside of Pakistan.</p>
<p style="text-align: justify;" dir="ltr">Also, it is subjected to interpretations in such a way that women have a right to anything major in the society. But often times, gender inequality is still experienced at home with the woman still delegated to common household tasks and subjected to public scrutiny when they make decisions or actions that are considered unbecoming of a woman. Pakistani women are subjected to ridicule as well when they adopt western people’s manner of dressing.</p>
<p style="text-align: justify;" dir="ltr">The abuse many people with different sexual orientation get is also very evident. Although they are treated with tolerance in the workforce and other instructions, they are not subjected to kind treatments in the society. Many are still heckled and abused because of their gender preferences.</p>

Collateral is nothing more than a security for the court until further proceedings have been met. The person is then released from prison until the trial date is scheduled. If the court feels that you are a &#8220;flight risk&#8221;, meaning that you may flee the law to avoid criminal charges, your chances of being released on bail are unlikely.</p>
<p style="text-align: justify;">After being arrested, you are then checked into a police station where an officer records detail information on you, along with the crime that you have committed, which may be a minor or federal offense. Your mugshots and fingerprints are then taken, along with any personal property that you may have, which is returned upon your release from custody. Then you are placed in a cell with other inmates. If you are charged with a minor offense, you can usually post bail immediately, or wait for a hearing at court, where the judge will determine if there will be bail, and what cost.</p>
<p style="text-align: justify;">The amount at which your bail is set usually depends on the crime committed, but is usually at the judge&#8217;s sole discretion, or based on the standard amount for that jurisdiction. Your prior criminal record is considered, as is your history, status in the community, and whether you are considered to be a danger to those around you. There are different types of bail, the most straightforward of which is cash bail, meaning that the bail is fully paid in cash, as a money order, via credit/debit card, and, sometimes, by personal check.</p>
<p style="text-align: justify;">The second type of bail is called a surety bond, or bail bond, which is most common when the accused cannot afford bail, although it can be used for any bail. An associate of the accused, such as their criminal defense lawyer, usually contacts someone called a bail bondsman, or bail agent, who is endorsed by an insurance or surety company who, in turn, must pay the entire bail amount if the accused does not appear for trial. The bail agent or bondsman charges the client a premium for this service, and usually collects some sort of collateral.</p>
<p style="text-align: justify;">An arrest does not always result in bail being required for the accused to be released from custody, however. A police officer or judge may choose to release a person on a citation, which requires the accused to appear in court at a specific date, also known as a summary offense. In these cases, the crime is usually minor and nonviolent, however they still require the accused to appear for court, even though they are released without bail.</p>

<p style="text-align: justify;">Alimony laws differ from state to state.  Some states have very strict guidelines.  For example, in states such as Tennessee and Texas, it is given to divorced spouses who have been legally married for at least 10 years.</p>
<p style="text-align: justify;">Some states have legal boundaries of how much the alimony should be, the duration of how long it should be given and other guidelines.</p>
<p style="text-align: justify;"><strong>1. Length of Marriage:</strong></p>
<p style="text-align: justify;">Most of the time, alimony lasts longer the longer the couples are married.  Marriages over 10 years calls ground for permanent alimony.</p>
<p><strong>2. Separation Time During Marriage:</strong></p>
<p style="text-align: justify;">States in the US view separation as either an event that leads to divorce or an event that is part of divorce.  This becomes an important issue for states requiring a 10 year marriage to qualify for alimony.  If a state recognizes separation as part of the marriage, then the years of separation qualify as “years of marriage”.</p>
<p><strong>3. Age during Divorce:</strong></p>
<p style="text-align: justify;">Younger couples are often given shorter alimony periods.  This is because the law views that younger partners are able to get back on their feet more smoothly than older couples.</p>
<p><strong>4. Income for Both Partners:</strong></p>
<p style="text-align: justify;">US law calls for spouses to carry on with the same quality of life and to maintain the same lifestyle even after divorce.  This is taken into consideration with alimony.  The court will factor in each party’s income and come up with the best medium ground.</p>
<p><strong>5. Health of Each Spouse:</strong></p>
<p style="text-align: justify;">Alimony factors in if a spouse has certain health problems or health needs.  It may be extended or the sum of alimony may be larger if the other partner is not able to support them.</p>

<p style="text-align: justify;"><img class="alignleft size-full wp-image-4717" title="Pakistani Student Immigration" src="http://www.pakistanlaw.net/wp-content/uploads/2012/05/Pakistani-Student-Immigration.jpeg" alt=" UK Tightens Pakistani Student Immigration Requirements " width="330" height="297" />A recent study from the UK Home Office discovered that current Pakistani student visa applications do not provide veritable representations of the applicants’ English language skills. The study was conducted by a pilot program that supplemented the traditional paper applications with face-to-face interviews between applicants and immigration officials. The pilot program revealed that 20 percent of applicants, who previously would have been accepted based on their paper applications, did not have the English proficiency demonstrated by their written answers and required for advanced study in the UK.</p>
<p style="text-align: justify;">Previously, approximately twenty percent of Pakistani applicants were rejected for UK student visas due to inadequate English skills. Since Home Secretary Theresa May instituted the interview element to the application process, the rejection rate has risen to 40 percent. The pilot program is now being implemented in 14 additional countries, including China, India, Egypt, Nigeria, Bangladesh, and Sri Lanka.</p>
<p>While these regulations may seem harsh, they are based on intensive studies from the National Audit Office, which uncovered records of at least 40,000 – 50,000 bogus Pakistani students, who had been issued UK Tier 4 visas in 2012 alone. Many of these bogus students used their UK Tier 4 visas to work in the UK, rather than complete their proposed studies. The number of these bogus students has risen approximately ten times from previous predictions from UK immigration officials, and many of these “students” are presently untraceable. While current UK immigration laws allow higher education students with UK Tier 4 visas to work part time during school sessions and full time during holidays, entirely disregarding the student element of their student visas is completely illegal. A government spokesperson has stated, “Britain is open for business to the best and the brightest, but our message to bogus students is clear. You will be found out, and you will be prevented from coming.”</p>
<p style="text-align: justify;">Despite these findings, many Pakistani students (including members of The National Union of Pakistani Students (NUPS) and participants of the Oxford University seminar, “New British Immigration”), as well as several members of the European and UK parliaments, believe the laws are discriminatory against Pakistani students.</p>
<p>Qaism Raza, NUPS Director General and Oxford student, argues that the new application system delays the overall visa process, causing time losses up to entire academic years for many Pakistani applicants. Raza encourages his government to protect its students from such excessive and discriminatory application practices.</p>
<p style="text-align: justify;">Other young thinkers, such as co-chairman of the Internal Affairs of Pakistan Young Leaders Council, Hussain Nadeem, believe this act reflects Pakistan-Indian tensions. Followers of this school of thought worry that the UK policy will last as long as the war on terror, and thus indefinitely.  These believers blame their own army for interfering with foreign policy.<br />
Hira Omar, the chairperson of the Education Committee of Pakistan Young Leaders Conference and student of Oxford University, looks wisely at the situation. She believes poor English language education in Pakistan is to blame for the high level of post-interview rejections. Hira would like to promote English education through the Pakistani government and encourages curriculum improvements in this direction.</p>

<p style="text-align: justify;">The Supreme Court of Pakistan last week released updates towards the admin of Capital Development Authority (CDA) and Islamabad chief commissioner over a disregard application relating to no implementation of SCP 2007 orders about Lal Masjid case.</p>
<h2>Tariq Asad clash with Supreme Court Bench</h2>
<p style="text-align: justify;">Three person SC bench, lead by Chief Justice Iftikhar Muhammad Chaudhry, noticed the suo motu case of Lal Masjid as well as Jamia Hafsa and also a disregard request submitted by Maulana Abdul Aziz. A spoken spat had been experienced between Tariq Asad, the lawyer for Maulana Aziz, and members of the SC bench. With the start of the case, Tariq Asad advised the judge to consider his disregard of court’s request however the courtroom requested him to hold back, his application will be listen later on but Tariq Asad, on the other hand, insisted the judge to listen to his application. The chief justice once again informed, &#8220;We have previously carried this out to some others.&#8221; &#8220;I don&#8217;t care,&#8221; Tariq stated, and quit the rostrum. Iftikhar Gilani, the lawyer for Wafaqul Madaris, instructed a legal court that this authorities hadn&#8217;t complied towards the court&#8217;s order about the Lal Masjid operation. The deputy lawyer general informed the judge how the management of Jamia Hafsa experienced created a contract using the governing administration throughout December 2011. Because of the particular agreement, the federal government had provided a 20-kanal land to Jamia Hafza in H-11. Gilani declared that even though authorities had assigned property, it had not been satisfying their dedication of creating a madrassa presently there according to the court’s 2007 orders. 			<content:encoded><![CDATA[<p style="text-align: justify;">On 23rd April 1989, Seaham teenager Stephen Rowley was involved in a disagreement with several members of motorcycle gang, known as the Druids, at Scarborough Mere.  An argument took place over accusations of dangerous driving and noise pollution, at the onsite racing circuit.  Sometime after the confrontation, members of the gang made their way to Rowley’s campsite, where a fight broke out and Rowley was stabbed to death.  At the ensuing court case, John Megson, who was at the time the Druids Vice President, was convicted of murder and sentenced to life with a recommended minimum 15 years in prison.</p>

<p style="text-align: justify;"><strong>A matter of honour</strong></p>
<p style="text-align: justify;">Although Megson was present when Rowley was killed and the victim’s blood was found on his sleeve, he was in fact innocent of the charges.   However, in keeping with the bikers’ Code of Silence, he refused to provide evidence to the trial as to who had in fact been involved in the fight that resulted in Rowley’s fatal injuries.  Despite Megson’s father trying for two years to convince his son to give up the names of those directly involved, his please fell on deaf ears.  Eventually his father arranged for Steve Smith, a solicitor in Rotherham, to visit his son at Wakefield Prison.  After just one meeting the solicitor was convinced that Megson was serving a sentence for a crime that he had not committed and began putting together an appeal.</p>
<p style="text-align: justify;"><strong>The Power of TV</strong></p>
<p style="text-align: justify;">Whilst Megson’s solicitor was working on securing a retrial, the movement gained some unexpected support in the form of a BBC TV series <em>Rough Justice</em>.  The series broadcast an episode dedicated to Megson’s case, which highlighted several flaws in the conviction.  The exposure served to swell awareness and support for the biker and an appeal hearing was arranged for May 1994.  At the Teesside Court Of Appeal a woman, who was present when the killing occurring, volunteered the name of the person that actually inflicted the fatal blows.  As a result Megson’s murder charge was quashed and he instead accepted a 7 year sentence for manslaughter.  Having already served 5 years, Megson walked free.  The Rotherham solicitor who had represented Megson then wrote a book, <em>Hell is Not for Angels, </em>which detailed the case and appeal, whilst offering an insight into biker life.  The BBC also made a follow up <em>Rough Justice </em>episode, which told the story of the appeal and subsequent release.</p>
<p style="text-align: justify;"><strong>Final justice</strong></p>
<p style="text-align: justify;">The evidence heard at the appeal saw charges brought against 4 other Druids members, who were accused of murder.  However, Rowley’s role in the story was not yet done and scientific evidence relating to him saw the judge order the jury to find the defendants not guilty of murder.  However, the case did continue with two of the accused, Simon Negrotti and Colin McCombie, facing charges of manslaughter.  The two bikers were finally found guilty in February 1997 and later sentenced to 6 years.  Although the judge accepted that the pair had not intended to kill Rowley, he did state that they were both responsible in some part for the death.</p>
